Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of TilikChat, an RCS Business Messaging platform operated by PT AMK ("TilikChat", "we", "us"). By creating an account or using the platform, you agree to be bound by these Terms.

If you are using TilikChat on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

2. The Service

TilikChat provides a multi-tenant SaaS platform enabling businesses to:

• Create and manage verified RCS Brand Agents
• Build and send RCS message campaigns to opted-in contacts
• Receive inbound messages and delivery analytics
• Manage contacts, templates, and billing

Message delivery is dependent on third-party infrastructure including Google RBM and Telkomsel. We do not guarantee 100% delivery as carrier conditions are outside our control.

3. Accounts and Access

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@tilikchat.com if you suspect unauthorized access.

You may not share account credentials between users. Each user must have their own named account under your tenant workspace.

4. Acceptable Use

You agree to use TilikChat only for lawful purposes. You must not use the platform to:

• Send messages to recipients who have not given explicit opt-in consent
• Send spam, phishing, or fraudulent messages
• Impersonate another business or individual
• Transmit malware, viruses, or harmful code
• Violate any applicable Indonesian law including UU ITE and PDP Law
• Send content that is illegal, defamatory, or violates third-party rights
• Attempt to reverse engineer, scrape, or disrupt the platform

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Messaging Compliance

You are solely responsible for ensuring that:

• All message recipients have given valid, documented opt-in consent
• Your messages comply with Google RBM content policies
• Your messages comply with Telkomsel's acceptable use policy
• You maintain opt-out records and honor unsubscribe requests promptly
• Your RCS Brand Agent registration information is accurate and current

Violations of carrier or Google RBM policies may result in your Brand Agent being suspended by Google or Telkomsel. TilikChat is not liable for such suspensions.

6. Fees and Billing

Platform subscription fees are billed monthly or annually in advance in Indonesian Rupiah (IDR). Message credits are purchased separately and consumed as messages are sent.

Fees are non-refundable except where required by Indonesian consumer protection law. We reserve the right to change pricing with 30 days written notice to registered users.

Accounts with overdue payments will be suspended after 7 days and terminated after 30 days. Data may be permanently deleted upon termination.

7. Intellectual Property

TilikChat and its underlying technology, design, and content are owned by PT AMK Indonesia. You retain ownership of your content, contacts, and campaign data.

By using the platform, you grant us a limited license to process your data solely to provide the service as described in these Terms and our Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by Indonesian law, TilikChat shall not be liable for:

• Message delivery failures caused by carrier or Google RBM issues
• Loss of business, revenue, or data arising from platform downtime
• Indirect, incidental, or consequential damages of any kind
• Actions taken by Google or Telkomsel against your Brand Agent

Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

9. Service Availability

We target 99.5% platform uptime excluding scheduled maintenance. Scheduled maintenance will be announced at least 24 hours in advance. We do not guarantee uninterrupted service and are not liable for downtime caused by third-party infrastructure.

10. Termination

Either party may terminate the subscription at any time. You may cancel by contacting support@tilikchat.com. We may terminate your account immediately for material violations of these Terms.

Upon termination, you have 30 days to export your data. After 30 days, data may be permanently deleted.

11. Governing Law

These Terms are governed by the laws of the Republic of Indonesia. Any disputes shall be resolved through the courts of Jakarta, Indonesia, or through mutual negotiation before litigation is pursued.

12. Changes to Terms

We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.
